A federal appeals court re-asserts the indefinite stall on Biden covid mandate on Friday which forces workers to get the vaccine or risk losing their jobs. The re-assertion of the vaccine follows a legal challenge from a coalition of states led by Texas.

“take no steps to implement or enforce the Mandate until further court order.”

The 5th circuit Appeals court ordered OSHA to halt any action until further court order. The ruling is the latest development in what is expected to be a very long court battle over the “legality of the mandate”.

After endorsing him this summer, former President Donald Trump is hosting a high-priced fundraiser for Texas attorney general Ken Paxton's reelection campaign in December.

Ken Paxton, Texas attorney general and vocal critic of Biden took to Twitter to air his approval of the court ruling.

Paxton wrote:
“Citing Texas’s “compelling argument[s],” the 5th Circuit has delayed OSHA’s unconstitutional and illegal private-business vaccine mandate. WE WON! Litigation will continue, but this is a massive victory for Texas and FREEDOM from Biden’s tyranny and lawlessness,”

The Fifth Circuit has allowed a stall on enforcement of the Biden Administration mandate on Nov. 6, 24 hours after the directive was made public. in its ruling on Friday, the court said “the mandate exposes [suers] to severe financial risk” and “threatens to decimate their workforces (and business prospects).”

The public reacted positively to the court ruling
“*Awesome*, *awesome*. Hopefully, it will get bound up in the court(s) so long the virus will be gone and the order will be rendered moot.”
“The foundation for the OSHA rule entirely relies on the idea the virus places the employees in “grave danger.”

“A few problems are easily identified here…
1) The vast majority and percentage of individuals who easily recover from the virus don’t support this claim. The survival and recovery rate simply doesn’t support the basis and foundation for establishing the OSHA rule.
2) Similarly, it cannot be said the virus only places employers with more than 100 employees in “grave danger” and somehow it doesn’t affect employers with less than that at all.
3) OSHA is required by law to protect all employers and all employees from occupational harm. They cannot engage in “selective enforcement” activities which is what this mandate is doing.”

 

“Also vaccinated people can still catch COVID and transmit the virus to others. So they are a danger to others too not just the unvaccinated. What I have researched indicates the vaccinated has a higher viral load and are super spreaders.”

 

“Has anyone, Republican or Democrat, suggested that being vaccinated be a requirement for getting government assistance, i.e., welfare? Why not? If workers are threatened with losing their paychecks, shouldn’t welfare recipients be threatened with losing their welfare checks?”

 

“Hey, how bout a requirement that all those who enter this country illegally get vaccinated or deported on the spot? Oh never mind,…that’s too much common sense for one day.”

 

“Now that’s an outstanding idea!! However, they are not making any of the illegal aliens to get vaccinated so highly unlikely.”

 

“Why do presidents get to make laws without being vetted for constitutionality? Executive orders need to be constitutional ‘before’ they’re enacted.”
